Terms of Service

1. Agreement to Terms

By downloading, installing, or using Producer Betty ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Gigaton AI, Inc. ("Gigaton," "we," "us," or "our"). We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

Producer Betty is an AI-powered music production assistant designed to help you with your Logic Pro projects. The App provides:

• Conversational AI assistance for music production questions
• Integration with Logic Pro for session awareness
• Voice command capabilities for hands-free operation
• Project notes and task management
• Session memory and continuity across conversations

3. Account and Eligibility

To use Producer Betty, you must:

• Be at least 13 years of age
• Have a valid Apple ID for sign-in
• Have a Mac running macOS 14 (Sonoma) or later
• Have Logic Pro installed for full functionality

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Subscription and Payment

Producer Betty offers both free and paid subscription tiers:

• Free Tier: Limited access to basic features
• Pro Subscription: Full access to all features, billed monthly

Subscriptions are processed through Apple's App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

To cancel your subscription, go to your Apple ID settings and manage your subscriptions. Refunds are handled according to Apple's refund policy.

5. Acceptable Use

You agree not to use Producer Betty to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's services or servers
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated systems or bots to access the App
• Transmit malware, viruses, or other harmful code

6. Intellectual Property

The App, including its design, features, and content, is owned by Gigaton AI, Inc. and is protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of any content you create using the App, including your music projects, conversations, and notes. By using the App, you grant us a limited license to store and process your content solely to provide the service.

AI-Generated Content: Responses generated by Betty are provided for your personal use in music production. You may use these suggestions in your creative work without restriction.

7. AI Limitations and Disclaimer

Producer Betty uses artificial intelligence to provide assistance. Please be aware that:

• AI responses may not always be accurate or appropriate
• The App is a tool to assist your creativity, not replace your judgment
• AI suggestions should be reviewed before implementation
• The App may occasionally misunderstand commands or context

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from using the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGATON AI, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Gigaton AI, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may stop using the App at any time.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of California.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after such changes constitutes acceptance of the new Terms.
