Terms of Service

These Terms of Service ("Terms") are a contract between you and Gigaton, LLC ("Gigaton", "we", "us") governing your use of the Gigaton Suite, Booking Forms, artist sponsorships, Betty, and our websites and apps (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.

Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be old enough to form a binding contract in your jurisdiction.

Subscriptions & billing

• The Gigaton Suite and Booking Forms are recurring subscriptions billed through Stripe at the price shown at checkout, plus applicable taxes.
• Subscriptions renew automatically until cancelled. You can cancel at any time from your billing settings; access continues until the end of the current period.
• Except where required by law, payments are non-refundable. A failed payment may lead to a grace period and then suspension of paid features.

Sponsorships (paying for others)

A sponsor may purchase one or more Suite seats for other artists. The sponsor is responsible for payment for all seats they buy; sponsored artists receive Suite access while the sponsorship is active. If a sponsor's payment fails or the sponsorship ends, the associated seats may lose access. Seats are for the artists they are assigned to and are not transferable except through the sponsorship tools we provide.

Your content

You retain ownership of the content you upload (songs, EPKs, images, setlists, etc.). You grant us a limited license to host, process, and display that content solely to operate and improve the Services (including generating AI outputs you request and rendering public pages you choose to publish). You are responsible for having the rights to the content you upload and for the content you make public.

Acceptable use

Do not use the Services to break the law, infringe others' rights, send spam, abuse the Booking Forms or invite email relays, attempt to bypass security or rate limits, or disrupt the Services. We may suspend or terminate accounts that violate these Terms.

AI features

Betty and other AI features generate outputs that may be inaccurate or incomplete. You are responsible for reviewing AI outputs before relying on them. AI features are provided "as is" and are not professional (legal, financial, or other) advice.

Disclaimers & liability

The Services are provided "as is" without warranties of any kind to the maximum extent permitted by law. To the extent permitted by law, our aggregate liability arising from the Services is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
